ESTATE PLANNING

Our firm represents clients with both large and small estates by providing sound advice and legal representation in order to provide for the needs of you and your loved ones. A sound estate plan allows you to prepare for disability and direct the distribution of your property. The goal of our representation is to save you tax dollars, professional fees, and court costs. Most importantly, you can maintain control of your own affairs. A properly designed estate plan will include instructions for your care, and that of your loved ones, in the event of your disability, be effective if you moved to or owned property in another state, avoid probate and its associative legal costs, keep your affairs private and confidential, control all of your property including pensions and life insurance, and ultimately allows you to leave explicit instructions for the care of your loved ones. TRUSTS:
Simply put, a trust puts money or property in the name of one person for the benefit of another. The creator of the trust is the "Settlor" or the "Trustor." The person who owns the property for another's benefit is the "Trustee" or the "Fiduciary." The person entitled to benefit from the trust is the "Beneficiary." The Settlor instructs the Trustee to manage the trust assets for the benefit of the Beneficiary.

We can assist you with the preparation of living, testamentary, revocable and irrevocable trusts with the advice and counsel that you need in order to make an appropriate determination of which type of trust(s) would be appropriate for you and your family.

See our Frequently Asked Questions about Trusts for further information.

POWER OF ATTORNEY:
A Power of Attorney is a document which allows someone else to act on your behalf. It can be broad or very specific. Powers of Attorney can be classified as either financial or medical. A financial power of attorney mainly allows a person to act on someone's behalf in regards to money or financial matters such as signing contracts, dealing with real estate, signing checks on a bank account, etc. The power of attorney can be a broad power or it can be limited in purpose. A medical power of attorney generally allows some other person the ability to act in medical situations such as consent to surgical procedures and the like.

LIVING WILLS:
A living will is a document which expresses your wishes as to what happens if you are unable to participate in decisions regarding your medical care when there is no reasonable medical expectation that you will regain your ability to participate in making such decisions.

CHILD GUARDIANSHIPS:
Our firm will provide speedy preparation of child guardianships which will address issues of medical authorization should your plans take you away from home and your children are to stay behind.

CHARITABLE GIFTS:
One of the most important but least used ways to avoid estate tax is a charitable trust or annuity. There are many twists to charitable giving and avoiding large estate taxation. We can help you find the best one for your situation. One way to avoid probate of an asset is to transfer it before you die. We have the skill and expertise to assist you in determining whether a charitable gift is the right vehicle for you in order to save your valuable estate dollars.
